Terms and Agreement
**Communications**
At Turf Titans FL LLC, we value open and effective communication with our customers. We offer several convenient channels for customers to reach us:
1. **Customer Portal**:
- The easiest and most efficient way to contact us is through the customer portal, where you can send us an instant message. This ensures that our team receives your message promptly, and all communications can be saved to your profile for future reference.
2. **Email**:
- You can also reach us via email at info@turftitansfl.com. Please ensure that all emails contain your first and last name in the subject line. This helps us quickly locate your lawn service profile and address your inquiry or concern.
3. **Phone**:
- If you prefer to speak with us directly, you can call us at 941-302-0362. If we are unable to answer your call, please leave us a voicemail with your name and the reason for your call. We will make every effort to return your call as soon as possible.

**Billing and Payments**
1. **Lawn Care Services**:
- Payment for lawn care services provided by Turf Titans FL LLC shall be rendered prior to the completion of the service. Customers may elect to receive invoices on a monthly basis or opt for automatic monthly debits. Customers opting for the "Bill Me Monthly" option acknowledge and accept an additional fee for administrative handling. Turf Titans FL LLC exclusively accepts payment via credit card or debit card, unless prior authorization has been obtained from senior management. In the event of payment failure during monthly renewals, Turf Titans FL LLC reserves the right to make three additional attempts to process the payment before the scheduled service date. Should payment remain outstanding on the day of the scheduled service, continuation thereof shall be subject to the sole discretion of senior management. Customers are granted a maximum grace period of 10 days to rectify outstanding payments to maintain service at the contracted rate. Failure to remit payment within this grace period shall incur a one-time charge of $25, and the monthly bill may be subject to revision to reflect the current rate. Customers bound by a 12-month contractual agreement shall be afforded an additional grace period of 5 days to rectify payment failure. In the event of non-payment within 15 days of the initial failure, services shall be terminated, and the customer shall be obligated to settle the remaining contractual balance within 45 days of termination. Failure to satisfy outstanding balances owed to Turf Titans FL LLC may result in legal recourse, including but not limited to litigation, debt recovery, imposition of liens, and any other lawful means deemed necessary to procure payment. Customers shall be liable for any and all expenses incurred by Turf Titans FL LLC in pursuit of debt collection.
2. **Landscape Services**:
- Customers contracting landscape services from Turf Titans FL LLC are required to remit a non-refundable deposit of 60% of the total agreed-upon fee upon acceptance of services to be scheduled. The remaining 40% balance shall be due within 72 hours of completion of the service and issuance of the final invoice. Failure to remit the outstanding balance within the stipulated timeframe shall result in the imposition of a late fee equivalent to 5% of the total bill. Customers failing to settle the remaining balance within 15 days of service completion shall be subject to the same collection procedures outlined for regular lawn care services, including but not limited to legal action, litigation, debt recovery, and imposition of liens. Turf Titans FL LLC reserves the right, contingent upon the nature of the service provided, to reclaim any and all materials utilized and installed for the landscape project in the event of non-payment. Said materials may be reclaimed for the purpose of either resale or return, with proceeds thereof being applied towards offsetting the outstanding balance, minus any costs incurred in executing such actions.

**Scheduling**
1. **Handling of Schedules**:
- Turf Titans FL LLC assumes full responsibility for managing all schedules related to the provision of services. Upon initiation of service, Turf Titans FL LLC shall dispatch a notification confirming the scheduling of said service. Customers can access their schedules through the designated customer portal section of the company website, titled "My Lawn Schedule." It is important to note that schedules are subject to change without prior notice, based on the operational needs and priorities deemed most suitable by Turf Titans FL LLC. Additionally, schedules provided are estimations of the proposed arrival time. In the event that a scheduled service appointment indicates a specific arrival time and Turf Titans FL LLC has not arrived by that time, customers are advised to wait until the end of the designated day before contacting us. In the event of a delay resulting in the inability to fulfill the scheduled service appointment for the day, customers shall be promptly notified via email and text message. Turf Titans FL LLC will provide a new proposed schedule for service, whether for the remainder of the week or indefinitely, as necessary.
2. **Weather Delays**:
- Turf Titans FL LLC acknowledges that weather conditions are beyond our control. Accordingly, Turf Titans FL LLC shall refrain from operating equipment during inclement weather conditions, as it poses safety risks to our crews and potential damage to properties. Our standard protocol for weather delays
involves allowing a window of 2-3 hours for storms to pass. Should a storm persist beyond this timeframe, Turf Titans FL LLC will cancel service for the day. Customers shall be promptly notified via email and text message of the weather delay and the subsequent rescheduling of their service. The decision to perform service during the week following a weather delay is contingent upon the severity of the storm and the accumulation of water on the lawn. Factors such as excessive water leading to potential lawn damage, unsafe conditions for machinery operation, and other pertinent considerations shall guide the determination of whether service will proceed as scheduled. In the event that service is deemed inappropriate for the week due to aforementioned reasons, customers will receive notification via email and text message, accompanied by an explanation for the decision.

**Lawn Service Agreement**
1. **Contractual Obligation**:
- Customers opting for a 12-month agreement with Turf Titans FL LLC are bound by a contractual obligation to pay for 12 consecutive months of service at the agreed-upon price determined at the time of signup. The type of service, whether Basic, Plus, or Full Titan Care, shall be determined upon enrollment.
2. **Cancellation**:
- Should a customer wish to terminate their service before the completion of the 12-month agreement, they are obligated to settle the outstanding balance for the remainder of the contract in full, as outlined in the Billing and Payment Standards detailed in Section 1.1. Exceptions to this requirement can only be made with the explicit authorization of senior management at Turf Titans FL LLC or if service is canceled by Turf Titans FL LLC for any reason. Turf Titans FL LLC reserves the right to refuse or cancel service to any individual at any time, at its discretion, without being obligated to provide justification.
3. **Continuation of Service**:
- Upon the conclusion of the initial 12-month agreement, the contract shall automatically renew for an additional 12 months. Customers will be guaranteed service for another consecutive 12-month period unless they choose not to renew their contract. Customers opting not to renew their contract and instead transitioning to a month-to-month arrangement will incur an additional fee, determined by the prevailing rate for services in their respective area. To terminate the contract and discontinue service with Turf Titans FL LLC, customers are required to provide a 30-day notice via email to Info@turftitansfl.com, indicating their intention to cease utilizing our services and to prevent the automatic renewal of their contract.

* Safety is our number 1 priority at Turf Titans FL LLC, while on location at your property you are required to keep all pets, children and other individuals at a safe operating distance from our machinery and equipment. This ensures the safety of our team and the safety of you as well.

**Postponing Weekly Service**
* At Turf Titans FL LLC, we prioritize the health and vitality of your lawn, striving to foster lush, green turf year-round. Our standard mowing schedule typically operates on a weekly basis from April through November. However, during the winter months spanning from December to March, our schedule transitions to bi-weekly services. This adjustment is reflective of the slower growth rate of grass and plants in colder temperatures, necessitating less frequent maintenance.
* **Skipping A Mow**: During the bi-weekly service period, Turf Titans FL LLC may opt not to mow your lawn on the scheduled day based on the assessment of our experienced crews. This decision is made with careful consideration for the well-being of your lawn and the promotion of optimal growth conditions. Choosing to skip a mow is a proactive measure aimed at preventing unnecessary stress to the grass and encouraging healthy, vibrant growth. Rest assured that even on days when mowing is not conducted, our dedicated crews will still arrive at the scheduled time to perform thorough inspections of your lawn and attend to any additional services outlined in your service agreement.

**Additional Fees**
1. **Prior Authorization**:
- Turf Titans FL LLC adheres to a strict policy requiring prior authorization for any additional fees incurred in conjunction with lawn and landscaping services.
2. **Service Tiers**:
- Turf Titans FL LLC offers three distinct service tiers to accommodate the varying needs of our customers:
1. Basic: Includes mowing, string trimming, edging, and blowing.
2. Plus: Encompasses all services provided in the Basic tier, with the addition of weed control.
3. Full: Comprises all services provided in both the Basic and Plus tiers, supplemented by hedge and shrub trimming, as well as small tree trimming. Note that tree trimming is limited to areas accessible from the ground.
3. **Authorization for Additional Services**:
- Should a customer request services beyond the scope of their chosen service tier, additional costs may be incurred. Customers will be presented with a detailed estimate for the requested services, and authorization must be obtained from the customer before any work is commenced.

**Additional Work with Deposits**
1. **Deposit Requirement**:
- Any additional work requested by the customer may necessitate the provision of a deposit before commencement of the work. For services exceeding a total value of $500, a deposit equivalent to 60% of the total estimated cost will be required.
2. **Payment Terms**:
- The remaining balance of the total cost for services exceeding $500 shall be due upon completion of the work.
3. **Prior Authorization and Deposit Payment**:
- No additional work will be undertaken by Turf Titans FL LLC until prior authorization has been obtained from the customer. If a deposit is deemed necessary for the requested work, it must be paid in full before the work is scheduled or initiated.

**Picking Up Items**
At Turf Titans FL LLC, we strive to provide efficient and high-quality service to our customers. To ensure the effectiveness of our operations and to maintain competitive pricing, we require all customers to keep their yards free of objects that may impede our service delivery. Such items include, but are not limited to, dog toys, children's toys, games, pet feces, hoses, gardening equipment, and any other debris or obstacles.
**Customer Responsibility**:
It is the responsibility of the customer to ensure that their yard is clear of
any such items before our crew arrives to perform the scheduled service. This proactive measure enables our team to work efficiently and effectively.
**Additional Charge**:
Failure to remove these items may result in an additional charge of $10 per visit if our crew is required to move these items in order to complete the service. This charge is implemented to compensate for the additional time and effort expended by our crew.

**Damages**
1. **General Policy**:
- Turf Titans FL LLC shall not be held liable for damages to irrigation systems, downspouts, sprinkler heads, and any other similar items that may occur during the course of performing services. While we make every effort to avoid damage, some areas may be unavoidably affected in order to complete the service.
2. **Damage Mitigation**:
- In the event that damages occur to the aforementioned items, Turf Titans FL LLC may offer to replace certain damaged items for an additional fee. However, it is important to note that certain areas, deemed unavoidable for service completion, may be susceptible to damage for which Turf Titans FL LLC is not liable. These areas include fencing, mailbox posts, swing sets, play areas, unprotected siding, unprotected stucco, unmarked plants outside of landscape beds, unprotected screen enclosures, etc.
3. **Notification and Resolution**:
- If an item is damaged due to an unavoidable area, Turf Titans FL LLC will promptly notify the customer of the damage and provide an appropriate cost estimate for repair or replacement. In the event that an outside company or service is required to repair the damaged item, the customer will be duly informed.
4. **Damages Caused by Negligence**:
- In the rare event that an item is damaged on the customer's property due to negligence on the part of Turf Titans FL LLC, we assume full responsibility and will expedite the repair or replacement of the damaged item.
5. **Liability Insurance**:
- Turf Titans FL LLC maintains a liability insurance policy with coverage up to $1 million to protect both ourselves and our customers from any accidents or damages that may occur during the provision of services.

**Warranties and Guarantees**
1. **Lawn Care Services**:
- Turf Titans FL LLC does not provide any warranties with respect to lawn care services. However, we are committed to ensuring 100% customer satisfaction. If you are dissatisfied with any aspect of the service provided, please contact us within 24 hours of the service being performed. Acceptable forms of contact include the customer portal, phone call, or email. Kindly inform us of the issue and the areas where we fell short in delivering 100% satisfaction. We will diligently work with you to find a resolution that meets your expectations and ensures your complete satisfaction.
2. **Landscaping Warranty**:
- **Labor Warranty**: Turf Titans FL LLC does not provide any warranty on labor for landscaping services.
- **Plant Warranty**: Any plants, shrubs, bushes, or trees purchased through Turf Titans FL LLC are covered by a 30-day warranty. Customers will receive guidelines outlining the care required to maintain the validity of this warranty. Failure to adhere to these guidelines will result in the voidance of the warranty.
- **Hardscape Warranty**: Turf Titans FL LLC does not provide any warranty on hardscape installations for issues such as product defects, discoloration, water spots, settling, erosion, or any other circumstances caused by external influences.
- **Product Warranty**: Turf Titans FL LLC does not offer warranties on products installed at the customer's request. The only available warranty is that provided by the product manufacturer. If removal, installation, or repair of a malfunctioning part or product is necessary, the customer will be responsible for any additional charges incurred.
3. **Warranty on Customer Provided Items**:
- Turf Titans FL LLC does not warranty or guarantee any items provided by the customer for installation or use at their request.

**Estimates and Scope of Work**
1. **Policy on Estimates**:
- At Turf Titans FL LLC, our policy on estimates is to prioritize simplicity and clarity. Overly detailed and complicated estimates can often be confusing and difficult to interpret. Therefore, we strive to keep our estimates as straightforward as possible. We include the major items requested by the customer and encapsulate the remainder of the work within a "Scope of Work" format. This approach ensures that customers can easily identify the materials requested while understanding the overall scope of the projected work.
2. **Detailed Estimate**:
- While our standard practice is to provide simplified estimates, Turf Titans FL LLC is happy to accommodate requests for a full written comprehensive estimate. Please note that there will be an additional $65 charge for the administrative time required to compile such detailed estimates.
3. **Acceptance of Estimates**:
- All estimates provided by Turf Titans FL LLC require prior authorization before any work can commence. To authorize an estimate, both Turf Titans and the customer must complete a DocuSign document of the estimate. Once signatures from both parties have been obtained, the customer must submit the required deposit payment in order to schedule the work. Projects will not be scheduled, initiated, or considered in progress until both of these steps have been completed.

**Arbitration**
1. **Conflict Resolution**:
- In the event of conflicts, disagreements, disputes, or complaints between Turf Titans FL LLC and a customer, both parties are expected to handle the situation professionally and responsibly. Turf Titans FL LLC maintains a zero-tolerance policy for unprofessional behavior. Should a customer engage in unprofessional conduct towards any Turf Titan employee, management, or team member, Turf Titans FL LLC reserves the right to immediately cancel and refuse future service without issuing refunds. Upon cancellation, the customer will receive an email notification of termination of services, and all further communication must be conducted in writing via email or certified letter.
2. **Communication Protocol**:
- **Certified Letters**: Any certified letters must be addressed to Turf Titans FL LLC, 1150 NW 72nd Ave Tower 1 Ste 455 #15495, Miami FL 33126, US.
- **Emails**: All emails regarding conflict resolution must be sent to info@turftitansfl.com with the subject labeled "Conflict Resolution (First Name Last Name)."
- **Text Messages and Phone Calls**: Any text messages or phone calls will be considered harassment and documented accordingly.
3. **Conflict During Landscape Projects**:
- In the event of conflict arising during a landscape project, Turf Titans reserves the right to remove themselves from the situation to prevent escalation. The project will remain on hold until a resolution is reached. No refunds will be issued, and no work will be performed until all matters are resolved.
4. **Disputes After Completion**:
- Customers must notify Turf Titans FL LLC via email at info@turftitansfl.com within 48 hours of project completion regarding any issues related to quality of work, materials, job details, or billing. Upon notification, Turf Titans
FL LLC will inspect the reported issues and address them accordingly. Failure to notify Turf Titans FL LLC within 48 hours will result in the customer waiving their right to dispute the issues.
5. **Arbitration Procedure**:
- In the event that a resolution cannot be reached through direct communication between the customer and Turf Titans FL LLC, both parties agree to engage in binding arbitration. The arbitrator shall be mutually agreed upon by both parties or appointed by the American Arbitration Association. The decision rendered by the arbitrator shall be final and binding on both parties. The prevailing party shall be entitled to recover reasonable attorney's fees and costs incurred in connection with the arbitration proceedings.
